Draft law on public order 9300

The center’s experts, together with people’s deputies, have developed proposals for improving legislation in the field of public order: Draft law on public order 9300.

Today, the work of law enforcement agencies must be centered on the task of making it possible to apply rapid response, with an emphasis on preventing possible offenses. The functions of law enforcement agencies in ensuring public order must be clearly worked out and enshrined at the regulatory and law-enforcement levels. Any inconsistencies in the work of law enforcement agencies in ensuring public order – conflicts of norms, gaps, and the like – automatically give rise to violations of the rule of law and cause negative consequences for the observance of human rights and freedoms.

Given the growing tension in society, the overall deterioration of the crime situation in the country, and the increasing number of violations, specifically in the area of public order, the regulatory and legal framework for the activities of the National Police in protecting public order urgently needs to be updated. This, in turn, will prevent a negative impact on the domestic situation in the country and will not allow the international image of Ukraine to deteriorate.

The crisis situation that has now arisen in Ukraine has provoked a rise in public order violations on the streets of cities, towns and villages.

The old methods can no longer stabilize the situation. Today we already have a law enforcement structure of a new format – the police, which is the successor of the patrol and guard service. However, the legislation we inherited from the era of the administrative-command system – the “Code of administrative offenses,” the “Statute of the patrol and guard service,” and so on – is unable to meet the requirements for ensuring public order, both    of law enforcement agencies of the new format and    of society.

Therefore, in order to optimize the current legislation of Ukraine and bring it into line with international standards, it is absolutely necessary to adopt the proposed Law of Ukraine “On public order,” as one that will promote the administrative principles of protecting the rights and freedoms of the person and citizen in accordance with world standards, and the education of citizens in the spirit of respect for the law, the Law and the State.
